FICA Refund Claims Information

Early Retirees

The University filed claims for refunds of FICA taxes paid from 1996 through 2005 in connection with incentive payments made under the University's Early Retirement Incentive Program (ERIP).  In 2006, the University brought a lawsuit seeking to recover these refunds.  In the three years since the lawsuit was filed, federal courts have issued decisions in other cases that are contrary to the University's position.  Therefore, the University does not believe that it will prevail in its lawsuit or that any refunds will be forthcoming to early retirees or to the University for any pre-2006 tax years.  Under these circumstances, the University does not plan to continue pursuing the litigation to recover ERIP FICA refunds or to file ERIP FICA refund claims for tax years after 2005. This does not, however, preclude individuals who received ERIP payments from pursuing their separate claims with the Internal Revenue Service.
